The below terms and conditions are in relation to the purchase, attempted purchase and handling of minutes. Terms used may include ‘customer’ ‘customers’ (you, your, the user), ‘service provider’ (Sun & Tan Ltd – Tan Monkey) and ‘services’ (packages, minutes and sessions).


WEBSITE

On accessing the Website (www.tanmonkey.co.uk) on this and on each subsequent occasion you will be deemed to have accepted all of the terms and conditions that apply to its use and to the facilities and services provided by it. We reserve the right to alter these terms and conditions of use at any time and it is your obligation to check if changes have been made. Your use of the Website after changes are posted on-line shall constitute acceptance of the new terms and conditions.

RESPONSIBLE TANNING

We strictly adhere to the Sunbed Act (2010) and under 18’s are NOT permitted to purchase UV packages or minutes and will NOT be permitted to use UV services in-store. We will ask you for proof of age before we allow you to use UV tanning equipment. Please don’t be offended if you are asked, this is for your safety. This would need to be photo ID in the form of a photo ID, for example passport or your driving license.


No person under 18 years of age is permitted to use the UV tanning equipment or enter tanning units or changing areas. There can only be one person in a tanning booth when the equipment is active.


At Tan Monkey, we take responsible tanning seriously. We require your sign up via the website (www.tanmonkey.co.uk), agree Terms & Conditions, input the mandatory questionnaire honestly and provide the necessary ID.  Should false information be provided, Sun & Tan Ltd reserves the right to revoke your membership.


You must leave a minimum of 12 hours between tanning session. You will be refused use of our UV tanning if there is less than 12 hours between sessions. 


You must use eye protection on every visit. Disposable eye wear is available at the premises.  Please use these to protect your eyes every time you tan.


Tanning creams purchased through the vending machine in store should be used following manufacturer's directions on the product and on your own risk.

 

WHO CAN USE UV SUNBEDS?

If you are undergoing medical treatment or have photosensitive skin, you must consult a medical professional before using our equipment.


If you are pregnant, we will not permit the use of our UV tanning equipment. We will not allow anyone within their first trimester to use booths under any circumstance, if you wish to use the booths in your second or third trimester, we will require you to sign a disclaimer form. If you have, or plan to have Botox or Dermal Fillers, we strongly advise speaking to a medical professional or your practitioner prior to using any UV tanning equipment.


Sunbed tanning systems should be treated with the same caution as normal sunlight. A tan should be built gradually, particularly if you have sensitive skin.


You must not use our tanning equipment if you have already been sunbathing in natural sunlight or had another sunbed that day (or plan to).


Never repeat tanning treatment if any signs of redness remain from previous sunbathing or tanning.


If you have an excessive number of moles (over 50) or have anyone in your immediate family who has had skin cancer, you should seek medical advice before using UV Tanning equipment.


Do not use if you suffer from: ill effects from normal sunbathing, epilepsy, giddiness or fainting, headaches or migraine, heart condition, blood pressure, hypertension, prickly heat, cold sores, allergies, skin ulcers.


Do not UV tan if you have had any of the following treatments in the last 24 hours; hot waxing, tattooing, bleaching, laser hair removal or electrolysis.


By using Tan Monkey equipment, you acknowledge your understanding that using tanning services may result in skin ageing and potentially increase the risk associated with certain skin cancers.


Persons with sensitive skin or no existing tan should restrict their first few sunbed sessions to a maximum of three minutes. It is also advised that cosmetics, perfumes and deodorants should not be worn during treatment.


Alcohol consumption or use of illegal substances is not permitted before or during your session. If Tan Monkey feels you may be under the influence, you may be turned away from using a tanning booth and your membership will be revoked.


Aggressive and unacceptable behaviour will not be tolerated and appropriate legal action will be taken.


Any damages incurred on the premises, by incorrect use of the equipment, will be subject to a monetary fine.


WHO CAN USE A TAN BOOTH?

Do not use Tan Monkey tanning booths and check with your doctor your suitability for tanning if you have asthma, suffer from eczema or psoriasis, have open wounds, cuts or burns, taking medication that may affect the level of your skin-ph (most commonly antibiotics),


Do not use tanning booth equipment if you have a pacemaker or other electro-medical devices which are sensitive to electromagnetic interference.


MEMBERSHIP

Membership is required to gain access to our premises and the use of the sunbeds. Membership is valid for 12 months from the day of purchase, unless otherwise stated. The Membership Fee is £10 paid annually via our website. Customers can only buy a membership online via our website (www.tanmonkey.co.uk). If customers decide to cancel their membership the £10 fee is non-refundable.

Your membership is exclusive to you. Your membership is not transferable and only you can redeem any credits or rewards accrued under the membership. Your membership is restricted to use in the salon it is purchased in.


We reserve the right to cancel your membership. This may happen, for example, if we suspect misuse of your membership.  We also reserve the right to pull any offer at any given time. All our offers are subject to availability.


Your account will have a membership fee attached to it and you acknowledge that this may be comprised if rules are not adhered to.


Available time options are 3 minutes, 6 minutes, 9 minutes and 12 minutes.


Tan Monkey has the right to cancel your membership if the rules are not followed.

  • You must be 18 years old.

  • No one is allowed to share their membership.

  • You must only enter the premises by yourself and not accompanied by another person who does not have a membership.

  • No children are allowed to enter the premises and fines will be applied.

  • No Smoking or vaping allowed on the premises and fines will be applied

  • When signing up you must disclose that all information provided is true and correct


DAMAGE/LOSS OF CUSTOMER PROPERTY

You must keep all property and belongings with you in the studio at all times. It is also the customers responsibility to check the room before leaving, to ensure they take all their property and possessions with them. Please note that Tan Monkey cannot accept any responsibility whatsoever for any loss or damage to customers’ property and possessions whilst on the premises.


CHANGES TO PERSONAL CIRCUMSTANCES

Customers are required to inform Tan Monkey immediately of any change in their circumstances that could affect their eligibility to use UV equipment. This would include any changes to their medical history, for example pregnancy, a change in medication or diagnosis of a new medical condition.


CHANGES TO CUSTOMERS ACCOUNTS

Please note that any changes to clients’ accounts can be made via email (ie title, name, address & email).


CANCELLATIONS

You can cancel your membership by requesting your account to be deleted and this will be done automatically.


PAYMENT

Our services and goods are priced inclusive of VAT and set out on the system at the date of your purchase. Prices are set out on our website and we take reasonable care to ensure that the prices of services and goods advised to you are correct.


Before making use of any of the services that we provide, you must make the relevant annual membership payment.


AGREEMENT

When you begin to use our services (except for when we refuse to provide our services or unable to do so), a contract will come into existence between you and us.


If we are unable or refuse to provide our services to you, we may inform you of this and will not charge you for the services.


We may change this agreement or our products and services at any time: to reflect changes in relevant laws and regulatory requirements; and to implement any required adjustments or improvements

We will make available to you, use of our services during our opening hours and subject to our availability.


If we are unable or refuse to make our services available to you due to an event outside our control then we will take steps to minimise the effect this may cause, provided we do this, we will not be liable for delays caused by the event.


If you do not provide us with any information we request from you, or `you provide us with incomplete, incorrect or false information, we may refuse to provide our services to you indefinitely. Failure to provide information or providing incorrect or false information may also impact on any liability that we may have towards you.


We reserve the right to suspend or remove any special offers without prior notice.


We may suspend our services to:

  • Deal with technical problems or minor technical changes: or

  • Update the services to reflect changes in relevant laws and regulatory requirements



ACCURACY OF INFORMATION AND DISCLAIMER

Tan Monkey will use its reasonable endeavours to ensure that all information on the Site is accurate.


You acknowledge that any reliance on any information or other material contained on this website is entirely at your own risk and all other warranties, undertakings, conditions and terms, express or implied, whether by common law, statute, custom, trade usage, course of dealings or otherwise (including without limitation as to quality, fitness for purpose, performance or suitability for purpose) in respect of the website are hereby excluded to the fullest extent permitted by law.


Nothing in these terms of use shall exclude our liability to you for fraudulent misrepresentation by Tan Monkey or its employees or for death or personal injury resulting from Tan Monkey negligence or that of our employees or shareholders, trustees, etc.


You acknowledge that we cannot guarantee that our website will always be available to you, owing to the nature of the internet. In addition, you acknowledge that our website may be unavailable owing to maintenance, but where possible we will carry out such maintenance outside core operating hours, and we will try to minimise the period of any disruption.


RELIANCE ON INFORMATION POSTED 

Commentary and other materials posted on our website are not intended to amount to advice on which reliance should be placed.  We, therefore, disclaim all liability and responsibility arising from any reliance placed on such materials by any visitor to our sites, or by anyone who may be informed of any of its contents.

CODE OF CONDUCT

You agree to ensure that any details which you supply to us through the website are accurate and to let us know promptly if any of the details which you have supplied to us about you change.


If accessing any part of our website that requires you to enter a password you agree to keep any personal login name and password for use on the website confidential, and to be responsible for any loss or damage resulting from use of your password by any third party.

We reserve the right to terminate your access to password-protected areas of our website should we consider that your use of the website is detrimental to the website or to other users.
